Terms of Service

These terms govern your use of the Blink Delivery app and website, operated by Blink Delivery ("Blink Delivery", "we", "us"). By creating an account or placing an order, you agree to them. If you do not agree, please do not use the service.

1. The service

Blink Delivery lets you browse snacks, drinks, essentials and other campus convenience items, place orders, and have them delivered to an address you provide on or near campus. All items sold are physical goods delivered to you. We do not sell digital content or subscriptions to app functionality.

2. Eligibility and your account

• You must be at least 18 years old, or the age of majority where you live, to place an order.
• You sign in with your phone number or email address using a one-time code, or with your Google or Apple account. Keep access to that phone number, mailbox or account secure.
• You are responsible for activity on your account. Tell us promptly if you believe it has been used without your permission.
• You may delete your account at any time from Profile → Delete Account.

3. Delivery areas

We deliver only to areas we currently serve. The app will tell you if your address falls outside our delivery area. Coverage may change over time. At launch, service is focused on the University of Nebraska–Lincoln campus and nearby areas we designate.

4. Orders

• Placing an order is an offer to buy. Your order is accepted when we confirm it in the app.
• We may decline or cancel an order — for example if an item is unavailable, the address is outside our delivery area, we suspect fraud, or there is a pricing error.
• Orders may be edited or cancelled within the window shown in the app. After that window we may have begun fulfilling the order and can no longer change it.
• Items are subject to availability. Where an item is unavailable we may substitute a comparable product or remove it and adjust the total.
• Items sold by weight or variable measure may vary slightly, and the final charge may be adjusted accordingly.

5. Prices and payment

• Prices are shown in the app and include applicable taxes unless stated otherwise. Delivery and platform fees are shown before you confirm.
• Prices and offers may change at any time before you place an order.
• Card payments are processed by our payment provider. By paying you authorise us to charge the amount shown at checkout.
• Wallet balance, gift cards, Blink points and promotional discounts apply as described at checkout. Wallet balance, points and gift card value are not redeemable for cash and are non-transferable except where the app expressly supports it.
• If a payment fails or is reversed, we may cancel the order and suspend the account until it is resolved.

6. Delivery

We aim to deliver orders quickly within our service area, typically by student riders on scooters or on foot. Delivery times shown in the app are estimates and not guarantees. Someone should be available to receive the order at the address given. If delivery cannot be completed because no one is available or the address is inaccessible, we may charge for the attempt or leave the order according to any instructions you provided in the app.

7. Cancellations, returns and refunds

• You may cancel before the order edit window closes for a full refund, subject to the rules shown in the app.
• If an item arrives damaged, spoiled, expired or incorrect, contact support and we will refund or replace it where appropriate.
• For hygiene and food-safety reasons, perishable goods cannot be returned once delivered unless there is a problem with them.
• Refunds are issued to your original payment method or to your wallet balance, and may take several business days to appear.

8. Acceptable use

You agree not to misuse the service, including by: providing false information; using another person's payment method without permission; abusing promotions, referrals, points or gift cards; interfering with or attempting to gain unauthorised access to our systems; scraping the catalogue; or abusing our staff or delivery partners. We may suspend or close accounts that do.

9. Intellectual property

The Blink Delivery name, logo, app, website and content are owned by us or our licensors. You may use them only as needed to use the service.

10. Disclaimers

The service is provided "as is". We do not warrant that it will be uninterrupted or error-free, or that product information, images or availability are always accurate. Always read the packaging for ingredient, allergen and safety information before consuming a product; packaging and formulations can change.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential losses, or for loss of profits or data. Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud. Where liability cannot be excluded, it is limited to the value of the order concerned.

12. Changes to the service and these terms

We may change the service or these terms. We will update the "last updated" date above, and for significant changes we will notify you in the app. Continuing to use the service after a change means you accept the updated terms.

13. Governing law

These terms are governed by the laws of the State of Nebraska, USA, excluding conflict-of-law rules. Courts located in Nebraska have jurisdiction, except where mandatory local consumer law gives you the right to bring proceedings elsewhere.
